Acceptance and eligibility

These Terms govern your use of ShareCapy’s website, desktop app, creator tools, widgets, beta programs, and related services. By using the service, creating or claiming a creator profile, connecting Twitch, requesting a payout, or opting into bandwidth sharing, you agree to these Terms and the Privacy Policy.

You must be at least 18 years old and legally able to agree to these Terms. If you do not agree, do not use the service and do not opt into bandwidth sharing.

The beta service and third parties

ShareCapy is a beta service that lets supporters select a Twitch creator and attribute estimated value from eligible, consented idle-bandwidth activity to that creator. Features, eligibility, availability, pricing assumptions, and provider relationships may change as the beta develops.

Mellowtel provides the underlying bandwidth workload service; Twitch provides channel and optional identity services; Stripe provides creator onboarding and payout services. They are independent services governed by their own terms. Review the Mellowtel Terms before opting in.

Creator attribution and estimated earnings

ShareCapy attributes eligible measured activity to the creator selected for the relevant period. Creator balances and supporter impact shown before settlement are estimates. Request availability, activity volume, conversion rates, creator revenue, and payout timing are not guaranteed.

We may reconcile estimates against Mellowtel or provider records and correct duplicates, delayed events, technical errors, invalid attribution, chargebacks, or suspected fraud. Corrections may increase or reduce a displayed or pending balance. No payout is earned until activity is validated and the payout is approved under the applicable process.

Creator ownership, payouts, and taxes

Creator ownership is verified through Twitch OAuth or another process we approve. You must provide accurate information and may claim only a creator identity you are authorized to control.

Creators may need to complete Stripe Connect onboarding, identity/KYC checks, payout-account verification, minimum thresholds, sanctions screening, tax documentation, and manual review. Payout requests may be held, corrected, rejected, reversed, or cancelled when required for compliance, provider rules, disputes, errors, or fraud prevention.

You are responsible for taxes, reporting, and obligations associated with amounts you receive. ShareCapy does not provide tax, legal, or financial advice.

Acceptable use

You may not misuse ShareCapy or help anyone else do so. Prohibited conduct includes:

  • Tampering with, fabricating, replaying, or spoofing request counts, node identifiers, creator attribution, balances, or device identity.
  • Using bots, automation, deceptive multiple identities, virtualized farms, or coordinated activity to manufacture eligibility or payments.
  • Reverse engineering or modifying the service to evade consent, rate limits, Game Guard, fraud controls, security controls, or provider restrictions, except where applicable law expressly permits it.
  • Interfering with security or availability, probing without authorization, introducing malicious code, or using the service for illegal activity.
  • Misrepresenting creator ownership, payment entitlement, network authorization, or your relationship with ShareCapy.

Device checks, Game Guard, and your control

ShareCapy may measure device and network readiness and may pause sharing when Game Guard detects likely full-screen game activity. These safeguards are designed to reduce interference, but they cannot guarantee that every game is detected or that participation will never affect performance, data usage, network reputation, or provider terms.

You remain responsible for monitoring your device and network. Pause or opt out immediately if you notice unexpected performance, security, data-usage, or network issues.

Intellectual property and feedback

ShareCapy and its software, branding, interfaces, documentation, and original content are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the service as intended; they do not transfer ownership.

You retain rights in content you submit and grant ShareCapy the permissions reasonably necessary to host, display, and operate that content. If you provide suggestions or feedback, you allow us to use them without restriction or compensation, while respecting any personal information under the Privacy Policy.

Changes, suspension, and termination

Because ShareCapy is in beta, we may add, remove, limit, pause, or discontinue features, providers, creator programs, or the service. We may suspend or terminate access to protect users or systems, investigate abuse, comply with law or provider requirements, or address a breach of these Terms.

You may stop using ShareCapy and opt out at any time. Terms that by their nature should survive—such as accounting corrections, intellectual property, disclaimers, liability limits, and dispute provisions—remain effective after termination.

Disclaimers and liability

To the maximum extent permitted by law, ShareCapy is provided “as is” and “as available.” We do not promise uninterrupted availability, compatibility with every device or network, any amount of bandwidth activity, creator revenue, payout, or freedom from all errors or third-party conduct.

To the maximum extent permitted by law, ShareCapy and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of profits, revenue, data, goodwill, or opportunity arising from the service. Any aggregate liability will be limited to the greater of amounts you paid directly to ShareCapy in the preceding twelve months or the minimum amount required by applicable law.

Where legally permitted, you agree to indemnify ShareCapy from third-party claims caused by your unlawful use, material breach, fraudulent activity, or unauthorized network participation. Nothing in these Terms excludes liability or consumer rights that applicable law does not allow us to exclude or limit.

Applicable law, changes, and contact

Applicable law and mandatory consumer protections govern these Terms. Disputes must be brought in a court of competent jurisdiction unless applicable law requires another forum or process. Before filing a claim, we encourage you to contact us so we can try to resolve it informally.

We may update these Terms as the beta, providers, or legal requirements change. Updated Terms apply from the posted effective date; where required, we will request renewed acceptance.
